Terms of Service for SquirreList

Welcome to SquirreList, a playful to-do list app designed by the 4EyesLearning Team ("we," "us," or "our") to help you "harvest your tasks" with Amrita the squirrel! These Terms of Service ("Terms") govern your use of our mobile application for iOS and Android ("App") and our website. By accessing or using SquirreList, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. Acceptance of Terms

By installing, accessing, or using SquirreList, you confirm that you are at least 13 years old and agree to these Terms. If you are under 13, you may not use the App. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you and is responsible for your use of the App.

2. License and Usage

We grant you a limited, non-exclusive, non-transferable, revocable license to use SquirreList on devices you own or control, for personal, non-commercial purposes, subject to these Terms and to the usage rules of the store you downloaded it from. You agree to:

• Use the App only as intended (task management and related features).
• Not modify, reverse-engineer, or attempt to access the App’s source code, except where the law allows it.
• Not interfere with the App or its servers, or try to access other users’ data.
• Not use the App for illegal activities, to store unlawful content, or to harass others.

This license may be terminated if you violate these Terms.

3. Account Responsibilities

To save tasks and sync them across devices, you must create an account with your email, Google, or Apple. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities under your account.
• Ensuring the accuracy of information you provide (e.g., display name, email).

Notify us immediately at support@4eyeslearning.com if you suspect unauthorized use. You can delete your account at any time in the App (Profile → Delete account) or as described in our Privacy Policy.

4. User Content

You retain ownership of tasks, notes, and other content you create ("User Content"). By using SquirreList, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content only to provide the App’s features (e.g., sync, reminders, streaks, the home-screen widget, the Squirrel assistant, and the Day Summary). This license ends when you delete the content or your account. We do not claim ownership of your content and we do not use it for advertising.

5. The Squirrel Features

• Squirrel assistant: When your day looks busier than usual, Amrita may estimate your chance of finishing it and suggest moving some tasks to another day. The estimate is a simple guess based on your past tasks, not a promise. The assistant only moves tasks after you choose to, and you can undo a move right after it is made. You are responsible for checking that your tasks and deadlines are where you want them.
• Voice: The squirrel voice and voice commands use your device’s text-to-speech and speech recognition services, which may not understand every sentence or be available in every language. Every voice action is also available as a button. See the Privacy Policy for how voice is handled.
• Day Summary and balance: The completion figures, focus time, and squirrel comments are for motivation only and depend on how you use the timer and task groups.
• Reminders and notifications: Notifications depend on your device settings and operating system and may be delayed or not delivered. Do not rely on SquirreList for urgent, medical, safety, or legal deadlines.

6. Third-Party Services

SquirreList uses third-party services to operate, such as Firebase by Google (accounts, database, storage, analytics, crash reports), Google Sign-In, Sign in with Apple, and your device’s speech services. Your use of these services is also subject to their own terms and privacy policies, including Google’s Privacy Policy and Apple’s Privacy Policy. We are not liable for their performance or practices.

7. Price, Payments, and Subscriptions

SquirreList is currently free and contains no ads or in-app purchases. If we introduce paid features or subscriptions, the price and terms will be shown clearly before you are charged, and payments will be handled by the Apple App Store or Google Play under their terms, including their cancellation and refund rules.

8. Intellectual Property

All content in SquirreList, including Amrita the squirrel’s design, voice lines, text, and graphics, is our intellectual property or licensed to us. You may not reproduce, distribute, or create derivative works without our written consent.

9. Disclaimers and Limitations of Liability

SquirreList is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. To the fullest extent permitted by law, we are not liable for:

• Any indirect, incidental, or consequential damages.
• Data loss or corruption due to App use.
• Missed tasks or deadlines, including after tasks were moved at your request or reminders were not delivered.
• Third-party actions or service interruptions.

Our total liability will not exceed the amount you paid us (if any). Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

10. Termination

We may suspend or terminate your access to SquirreList if you violate these Terms. You may stop using the App and delete your account and data at any time via the App or by contacting us. Upon termination, your license to use the App ends, and your data is deleted as described in our Privacy Policy.

11. Apple App Store and Google Play

If you downloaded SquirreList from the Apple App Store:

• These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content, maintenance, and support.
• Apple has no obligation to provide any maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• We, not Apple, are responsible for any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that the App infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement, and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded SquirreList from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

12. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes will be resolved in the courts of Đà Nẵng, Vietnam, unless the law of your country gives you the right to bring a claim where you live.

13. Changes to These Terms

We may update these Terms to reflect changes in the App or legal requirements. Updates will be posted here with a new "Last Updated" date. Continued use after changes constitutes acceptance.
